3.1 Scope and agreement structure
These Terms govern ClubPass365’s website and enabled applications and services. The Ticket Buyer Terms govern ticket orders; the Event Organizer Agreement governs organizer services; the Privacy and Cookie Policies explain information practices. Event-specific terms supplement these documents only if disclosed before purchase and consistent with mandatory rights.
Affirmative acceptance will be requested for account creation, orders and organizer onboarding where appropriate. A link in a footer does not by itself establish valid agreement to every contractual term. A privacy notice is not a blanket consent to every use of information.
3.2 Platform and event responsibilities
ClubPass365 operates an event discovery and ticketing marketplace. Unless an event expressly identifies ClubPass365 as its organizer, the listed Organizer is responsible for producing it. ClubPass365 remains responsible for its own services, representations and statutory duties. Third-party performance cannot be guaranteed, but this does not remove remedies for our own failures.
3.3 Accounts and eligible use
Users must have legal capacity to enter the relevant transaction or an appropriate parent or guardian’s authority where legally permitted. Organizer accounts require an adult authorized representative. An event’s age restrictions apply independently of account access.
Provide accurate information, protect credentials and promptly report suspected misuse. Email/password and any enabled social sign-in are alternative authentication methods; third-party availability is not guaranteed. Account linking requires a reliable authorized identity match. No Apple or phone sign-in is promised by these Terms. Available methods are those shown on the service.
Customer accounts do not confer organizer privileges. Users must not share administrator or check-in credentials to bypass approval or permissions. ClubPass365 may reasonably verify identity when necessary for security, support or legal obligations without requesting excessive information.
3.4 Discovery and account features
Search, category filters, maps, wishlists, recommendations, organizer follows and recently viewed content assist discovery. Saving or following does not reserve tickets, lock prices, guarantee availability, or subscribe a user to unrelated marketing. Map routes and distance estimates are guidance, not safety or accessibility assurances. Users should confirm venue details and travel arrangements.
Countdowns, availability displays and check-in or sales statistics depend on source data and synchronization. They must not be presented as guarantees. Calendar links copy event details to another service; subsequent changes may not update a saved calendar entry automatically.
3.5 Permitted use and prohibited conduct
You may use the Platform for lawful personal or authorized business purposes. You must not impersonate others; submit fraudulent orders or events; exploit payment or coupon errors; duplicate or tamper with QR tickets; evade access controls; deploy ticket-buying bots or bypass purchase limits; distribute malware; harass users; infringe rights; or scrape personal information without lawful authority. Security research must not expose customer data or disrupt services; report suspected vulnerabilities privately to support@clubpass365.com.
3.6 Content and intellectual property
ClubPass365 and its licensors retain rights in platform software, design and brand assets. No ownership is transferred through access. Users retain their own content and grant the limited rights needed to host, display, moderate and provide the requested service. Organizer promotional licences are addressed separately in the Organizer Agreement.
Reviews must reflect genuine experiences, disclose material incentives and avoid private information, unlawful material or misleading claims. ClubPass365 may moderate reported content consistently and may retain necessary evidence. To report infringement, identify the protected work, disputed material, its location and your authority to complain. Reports must be accurate.
3.7 Promotions and external services
Offers, featured listings and competitions are subject to clearly stated eligibility, dates, limits and applicable separate terms. No discount is promised merely by subscribing unless the promotion expressly offers it. Paid placements will be identified where required. Purchase is not consent to promotional email.
Payment, social sign-in, hosting, map, video and other external services may apply their own terms. Their involvement does not excuse ClubPass365 from duties relating to its selection, integration or use of those services. We do not guarantee external uptime or content.
3.8 Service interruption and account restrictions
Maintenance, network failures and security incidents may affect availability. ClubPass365 may make proportionate changes or restrictions for legitimate operational reasons. Where practicable, affected users will receive notice and assistance. Restrictions must not be used to defeat valid refund requests or access to records required by law.
3.9 Liability and statutory rights
Except for express commitments and rights that cannot be excluded, the Platform is provided on an available-service basis. ClubPass365 does not guarantee a particular event experience or uninterrupted access. Responsibility for loss is determined by applicable law, the relevant agreement and the circumstances. These Terms do not impose a blanket waiver of injury claims, exclude our own unlawful conduct, or eliminate consumer warranties, refunds or other non-waivable remedies.
3.10 Disputes, changes and general provisions
Contact support@clubpass365.com with the relevant account or order reference to request resolution. Informal discussions are encouraged but do not prevent complaints to authorities, lawful payment disputes, urgent relief or court proceedings. These Terms do not require consumers to waive class proceedings or submit to mandatory pre-dispute arbitration where those rights are protected.
Ontario law and applicable Canadian federal law govern, subject to mandatory protections in the user’s jurisdiction. Any Ontario forum provision is subject to rights to bring proceedings elsewhere. A legally ineffective clause is severed only to the extent permitted; the remainder continues where workable. Material updates will be notified appropriately and require renewed acceptance where required. Existing purchases retain applicable purchase-time rights.
